1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to create an account and use the paid features of RiskPicks. By creating an account you represent and warrant that you meet this age requirement and that you are legally able to enter into a binding contract in your jurisdiction. If we learn that we have collected account information from a user who does not meet this requirement, we will delete that account.

2. No Financial Advice

RiskPicks is an informational tool only. Nothing on this site constitutes financial advice, investment advice, trading advice, or any other form of professional advice. You should not treat any of the content or calculations provided by RiskPicks as a recommendation to buy, sell, or hold any security or financial instrument.

3. Use at Your Own Risk

All use of RiskPicks is at your sole risk. You are entirely responsible for your own investment and trading decisions. We are not responsible for any losses, damages, or costs arising from your use of or reliance on any information or calculations provided by this service.

4. No Guarantee of Accuracy

While we strive to provide useful tools and accurate data, we make no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, reliability, suitability, or availability of any information, calculations, stock quotes, market data, or related content provided through RiskPicks.

Stock quotes, market data, and technical indicators are sourced from third-party providers and may be delayed, inaccurate, or incomplete. Position sizing calculations are mathematical tools and do not account for all factors that may affect your trading outcomes.

5. No Guarantee of Availability

We do not guarantee that RiskPicks will be available at all times or that the service will be uninterrupted, timely, secure, or error-free. We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice.

6. Not a Broker or Financial Institution

RiskPicks is not a registered broker-dealer, investment adviser, or financial institution. We do not execute trades, hold funds, or manage accounts on your behalf.

7. Brokerage Integration

RiskPicks offers an optional brokerage connection feature powered by SnapTrade. This feature provides read-only access to your trade history for journaling and analytics purposes. RiskPicks cannot and does not place orders, transfer funds, or modify your brokerage account. You may disconnect your brokerage at any time. Use of this feature is subject to SnapTrade's own terms of service.

8. AI-Powered Features

RiskPicks offers AI-powered features including AI Sentiment, AI Coach, and Market Pulse. These features are powered by third-party AI services and are not financial advice. By using any AI feature, you acknowledge and accept that the output is for informational and educational purposes only.

When you use AI features, anonymous data (such as symbols, prices, position sizes, P&L, timestamps, and self-ratings) is sent to AI providers for analysis. No personal identifying information (username, email, account ID, or brokerage credentials) is included in these requests.

RiskPicks is not responsible for the accuracy, completeness, or reliability of AI-generated analysis. AI-generated content may contain errors, omissions, or outdated information. You should always consult qualified financial professionals before making investment decisions.

9. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during registration and to keep your contact information current. We reserve the right to suspend or terminate accounts that violate these terms.

10. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools to scrape, crawl, or extract data from the service
• Interfere with or disrupt the service or its infrastructure
• Redistribute, resell, or sublicense access to the service

11. Intellectual Property

All content, design, and code comprising RiskPicks are the property of RiskPicks and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our service without explicit permission.

12. Third-Party Trademarks

Company and product names mentioned on this site (including without limitation ChatGPT, Claude, Perplexity, Gemini, Grok, OpenAI, Anthropic, Google, xAI, SnapTrade, Stripe, Schwab, TD Ameritrade, Fidelity, Interactive Brokers, Robinhood, Polymarket, and any other referenced third-party brands) are the trademarks or registered trademarks of their respective owners. Use of these names on RiskPicks is for identification and comparative reference only and does not imply affiliation with, endorsement by, or sponsorship from any of these parties.

13. Indemnification

You agree to indemnify, defend, and hold harmless RiskPicks, its operators, officers, directors, employees, and agents from and against any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to your use of the service, your trading or investment decisions, your breach of these Terms, or your violation of any applicable law or regulation.

14. Limitation of Liability

To the fullest extent permitted by law, RiskPicks and its operators shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of or inability to use this service, including but not limited to losses from trading decisions made using information or calculations from this site.

15. Subscription, Billing & Refunds

RiskPicks offers a free tier and paid subscription plans billed monthly or annually. Paid plans include a 5-day free trial that does not require a credit card.

Automatic Renewal: Subscriptions are billed in advance on a recurring basis (monthly or annually) on the date you first subscribe. Your subscription will automatically renew and you will be charged the applicable subscription fee unless you cancel before the next billing date. You can view your next billing date in Settings.

Cancellation: You may cancel your subscription at any time with one click from Settings. No cancellation fees. When you cancel, you retain access to paid features until the end of your current billing period. No partial refunds are issued for unused time within a billing period. You may also cancel by emailing support@riskpicks.com.

Refunds: Because you have access to the full service during your billing period, refunds are generally not provided. If you believe you were charged in error or experience a technical issue that prevented you from using the service, contact us within 7 days of the charge and we will review your request on a case-by-case basis.

16. Governing Law, Jurisdiction & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Arbitration: Any dispute, claim, or controversy arising from or relating to these Terms or your use of RiskPicks shall be resolved by binding arbitration administered by a recognized arbitration provider in Texas. Each party waives the right to a jury trial and to participate in a class action or class-wide arbitration. The arbitrator's decision shall be final and binding. This arbitration clause does not apply to claims for injunctive relief or claims brought in small claims court.

17. Changes to These Terms

We reserve the right to update these terms at any time. Changes will be reflected by the "Last updated" date at the top of this page. Continued use of RiskPicks after changes constitutes acceptance of the updated terms.
